A leading Aberdeenshire organic recycling company is warning local food businesses to comply with Scottish waste legislation or face receiving new on-the-spot fines.
Keenan Recycling, which is headquartered in New Deer, is urging business owners to comply with their duty of care for waste to avoid the £300 fines that have been imposed on non-compliant firms since June this year.

Since 1st January 2016, it has been a legal requirement for all businesses that produce more than 5kg of food waste per week to have food preparation waste, spoiled items and plate waste collected separately for recycling by a registered waste carrier.

The Scottish Environment Protection Agency (SEPA) has started its fixed monetary penalty (FMP) campaign to identify businesses that are persistently non-compliant with the duty to separate food waste and other key materials for recycling.

Keenan Recycling, which turns food and garden waste into compost for farming and horticultural use, was the first company in Scotland to provide businesses with the opportunity to recycle items such as leftover food and coffee grounds.

The firm is now working alongside organisations such as SEPA, whose FMP campaign targets offices, retailers, restaurants, hotels, bars, cafes and takeaways that are failing to acknowledge and adhere to the regulations.

SEPA is tackling the issue by working in partnership with local authorities to identify persistent non-compliance within organisations across Scotland. Those found to be making no effort to make improvements to their waste management system will face a £300 fixed monetary penalty.

Keenan Recycling provides comprehensive guidance and advice to its customers, ensuring that they are all fully up to date with waste regulation.

Eleanor Strain, senior policy officer for SEPA’s national waste unit, said:

“Since starting the campaign, most offenders are making a conscious effort to train their staff to recycle and secure an improved service from their waste management contractor. The penalty system we’ve introduced is a much more proportionate enforcement tool, and gets the attention of small business owners who may not be aware of the legislation.

“Whilst I appreciate that SMEs have lots of other pressures, it’s important that they are aware of laws which can have a direct impact on their business. It’s simple to remain within the law, make sure that  recycling systems are established and all bins are labelled to avoid mixing food waste, recyclables and non-recyclables.”

“Companies need to ensure that they have suitable plans in place to keep them in line with the duty to recycle. Disposing of food waste will keep them within the law and also helps the environment.

“Businesses that are struggling to abide by waste legislation need to remember that they may lose their consumer confidence, as customers want to know that businesses are acting responsibly and are helping to look after the environment.”

Aberdeenshire councillors Paul Johnston and Martin Ford have welcomed support from sustainable transport charity Transform Scotland for the re-opening of the Buchan rail line to at least Ellon.

Writing to Councillors Johnston and Ford, Paul Tetlaw, rail spokesperson for Transform Scotland, said:

“In our view Aberdeen is very poorly served by rail and cities of comparable size in continental Europe would most likely enjoy a suburban rail network and some form of tram or metro system. So we would certainly support plans to re-open the railway from Dyce at least as far as Ellon.

“You are in the fortunate position that the former track bed is largely in local authority ownership. In contrast large parts of the Borders railway had been dispersed into multiple ownerships and it is estimated that as much as 40% of the cost of re-opening the Borders line was incurred through having to retrieve and suitably re-instate the sections of the route that had been lost.
 
“There are other lessons to be learned from the Borders line – and these may well have parallels for you. The passenger forecasts for the re-opened stations in the Borders were hopelessly pessimistic. Indeed it is probably true to say that of all the recent rail re-openings across the UK the projections for the stations at Tweedbank and Galashiels were by far the most inaccurate.

“Passenger numbers at Galashiels have in reality been five fold those projected while those at the Tweedbank park and ride site are ten fold the projections. Clearly such errors in the projections led to a poorer business case for the railway and politicians found themselves needlessly having to defend the case for the re-opening. Had the correct projections been used then it would have been clear to all concerned that the railway would be a great success and would be much welcomed by people in the Borders.
 
“The parallels that I would draw in your case are for potential stations in Ellon (Galashiels) and a park and ride beyond (Tweedbank). It is interesting to note that from day one the car park at Tweedbank has been full and overflowing – clearly demonstrating that people are quite prepared to drive in from surrounding towns and villages and then leave their car and take the train into the city.
 
“As a final point I would draw attention to the declared ambitions at both national and local government level to increase the use of public transport and decrease the reliance on the car. It is therefore clear that only a scheme that improves the public transport offering will deliver on these ambitions, any further road building will simply ensure yet greater car use with all the negative impacts on air quality, public health and congestion.”

Mr Tetlaw came to Aberdeen last week for a meeting with Nestrans but also met Cllr Ford and Cllr Johnston during his visit.
 
Cllr Martin Ford said:

“The very positive comments from Mr Tetlaw highlight that re-opening the Buchan line presents less of a difficulty than other lines where the track bed has been sold off piecemeal to multiple owners. Also, that we must not underestimate the potential for park-and-ride when forecasting likely levels of use.”

Cllr Paul Johnston said:

“The proposal to re-open the Buchan line to at least Ellon is gaining more and more support.”

A new option is to be included in on-going studies looking at the possibility of re-opening the former Buchan rail line from Dyce to at least Ellon.
The suggestion of re-opening the Buchan line as far as a park-and-ride station just north of Ellon was put forward by East Garioch councillor Martin Ford at the North East of Scotland Transport Partnership (Nestrans) meeting on 30 September.

The Dyce to Ellon section of the long-closed Buchan rail route has been regarded as the most likely to meet value-for-money criteria for possible re-opening.

In making the proposal for a short additional length of line at the Nestrans board meeting, Cllr Ford cited the passenger numbers on the re-opened Borders line. While overall levels of use of the new Borders Railway during its first year have been well above predictions, passenger numbers have been highest and most above forecast at Tweedbank, the park-and-ride station at the end of the line.

“The unforeseen popularity of long-distance park-and-ride on the re-opened Borders Railway is noteworthy,” said Cllr Ford.

“The success of Tweedbank as a park-and-ride station has contributed disproportionately to the overall success of the Borders Railway.

“The Borders line experience suggests it is well worth looking at the possibility of replicating the model of re-opening to a terminus that provides a convenient park-and-ride facility for the area beyond.

“For the Buchan line, that could mean continuing the railway to a station just beyond Ellon which is easily accessed from the north by bus and car.”

The A948 north of Ellon passes close to the alignments of both the former Boddam branch and the Formartine and Buchan line to Fraserburgh and Peterhead.

Cllr Martin Ford said:

“I believe there is a good case for re-opening at least the southern part of the Buchan railway, but it’s crucial to identify the option with the best benefit:cost ratio to maximise the chances of getting the go-ahead.

“The continuation of the Borders Railway two miles beyond Galashiels to provide a popular park-and-ride facility at Tweedbank has made a major contribution to the success of that rail re-opening. We need to investigate whether doing something similar at Ellon could boost the case for re-opening the railway from Dyce.”

The Nestrans board at its meeting on Friday agreed to continue feasibility studies into future transport options for the Aberdeen/Ellon/Peterhead/Fraserburgh corridor, and to include re-opening the Buchan rail line from Dyce to a park-and-ride station just north of Ellon as one possible option for consideration.

Mid-Formartine councillor Paul Johnston welcomed the Nestrans decision.

“Park-and-rail evidently has potential not just for north of Ellon but also for the B999 corridor at Udny and the A947 corridor at Newmachar. So it’s important to look at all the options,” he said.

Is Mother Nature Beating Trump Back? A Freedom of Information request response indicates the Marram-haired moghul is no match for Mother Nature. The FOI disclosure also shows that while the club and the Shire have a chummy, joking relationship, they are failing to keep the Master Plan updated. Suzanne Kelly reports.

empty-golf-course2016 correspondence between Aberdeenshire and Trump International Golf Links Scotland indicates all might not be well at the so-called ‘World’s Greatest Golfcourse’.

The Masterplan is not looking particularly masterful.

Scotland’s shifting sand dune system appears to lack the level of deference Aberdeenshire has shown to Trump so far.

A Freedom of Information Request was lodged to disclose:

“… all correspondence – whether electronic or paper based between Aberdeenshire Council and Trump International Golf Links Scotland, Menie Estate, Balmedie AB23 8YE, and / or any parent company thereof concerning: environmental health issues, use of chemicals, waste management including incineration of waste, drainage, ‘bunds’ such as those near Leyton Farm Cottage on Leyton Farm Road, animal populations, use of private security firms, data protection compliance for the year 2016 to date.

“Such correspondence might be to or from: Sarah Malone, Sarah Malone-Bates, Sarah Bates, Donald J Trump, Donald Trump, Donald Trump Jr, George Sorial.”

The heavily redacted response (some pages are fully redacted) shows that sand and wind are causing havoc.

*  A 22 February memo refers to a site visit which took place on 19 February. This email memo indicates work was done on the burn and the dunes; an email presumably from the Shire council asks for photographs of the burn prior to works being carried out.

*  on 23 February, someone (presumably a TIGLS employee) wrote back with the requested photographs to say:

“… you will clearly see that the burn is full of sand which has caused the water levels to rise and flood and cause damage to our bridge, etc. You guys personally witnessed the sand/blow movement that was blowing sand into areas of the burn. And that was not even a dry windy day. 

“The pictures of the dunes again you will clearly see we did not clear any existing marrum grass of [sic] the dune itself. All these areas were pure sand caused by the storms which resulted in the sand blowing all over the 4th hole and filling up the burn on the far side. 

“As you witnessed we are doing our best to replant with Marrum to try and save/stabilize the dune and also protect our championship golf course. Also you will see the tunnel/area where it was cutting through from the sea to the golf course.” 

Perhaps attempting to stabilize a sand dune system on the North East coast of Scotland in Winter was not such a good idea.

The Shire subsequently acknowledges that the before and after pictures ‘shows the damage’. There is banter between the parties as to how cold it was on the visit, and how being a marram planter is not one of the visitor’s career choice. The conversational tone is perhaps not the same as the Shire’s planners use when dealing with normal members of the public who have had planning breach issues.

When the planning and environmental issues were dealt with by the Scottish Reporters’ Report, when the golf complex was approved, the idea was to have environmental monitoring that would be robust and thorough. This is not happening.

On 10 March, stating the obvious – i.e. that the dunes are not static – the Shire writes:

“Having reviewed the approved Management Plan this does not cover such events [presumably the winter storms; if so this would seem to be a major oversight] in sufficient detail (Major blow out of the dune ridge). These dune systems are very dynamic in nature [you don’t say] and one of the features it is [sic] particularly noted for is the mobility of the dunes. Therefore it is likely that the same event could reoccur in the future.

“The dunes between the Ythan Estuary and Blackdog have been identified by Aberdeenshire Council as a Local Nature Conservation Site – a regionally important site for biodiversity and geomorphology. One of the key features of the golf course at Menie [is] the nature of this stretch of coastline will change in nature but it is important to manage future events to minimise the disturbance to the dune ridge.”

Is the Shire suggesting that the protection of the club needs to be managed? Who will weigh whether such future ‘management’ will have a negative impact on biodiversity and tne nature of the unique dune system? Certainly not Professor Bill Ritchie. Ritchie was quoted in the Reporters’ Report as supporting the Trump scheme.

He was to have kept the environmental watch group ‘MEMAG’ working – but as its minutes show, MEMAG descended into shambles, with Trump personnel skipping meetings. Ritchie never commented on this situation.

The email continues, noting a rather serious failure; the Management Plan is not being reviewed annually:

“I note that the Management Plan states it is to be reviewed annually which has not been the case as far as I am aware. Therefore I would request that this is reviewed in light of the recent storms and steps identified of how to deal with future storms with particular emphasis on the watercourse and coastal dune ridge. 

“This would enable future storm damage to be dealt with without the same intervention from outside agencies [what agencies? one wonders] and minimise any long term damage to these dunes.”

Is so-called ‘long term damage’ the same as the dunes following the previously-natural moving and shifting pattern? Did the environmental experts do their job correctly in approving the area for a golf course? The case could be made that the environmental experts might have underestimated the power of storms and the dynamic nature of the dunes.

Having stood on part of a collapsed course some years back, and reading this now – it looks like a case could be made that the experts got it badly wrong.

The email continues:

“We would consult with SNH, Environmental Planners and SEPA on the proposals. … In addition I would request that the Habitat Management Plan is also reviewed in relation to Otters to avoid further complaints regarding their habitat.”

It could be inferred that the Habitat Management Plan is possibly not updated either, seeing as the Management Plan is not being updated. Sadly, the emphasis is clearly on avoiding complaints regarding otter habitat rather than on protecting the otters, their habitat, and other wildlife.

Perhaps this failure to properly estimate the dynamic dunes, the wildlife and the storms means that an overly-rosy picture was painted by the golf resort’s protagonists? From here, it looks like development of a wild place at all costs prevailed on the day the course was permitted.

However, it now seems Mother Nature has failed to read the memo on Trump’s vision for the ‘world’s greatest course’ and is taking a bit of direct action herself.

East Garioch councillor Martin Ford is delighted that Aberdeenshire Council’s Garioch Area Committee is to decide this Tuesday (31 May) on supporting a funding bid to the Scottish Stations Fund for the proposed station at Kintore.

Cllr Ford has been campaigning for a new station at Kintore for many years.

He said:

“Assembling the funding package to enable a Kintore station to be built is clearly an essential step towards delivering that goal. And an application to the Scottish Stations Fund has always been seen as a key element in the expected overall funding mix.”

The report to the Garioch Area Committee highlights the strength of the business case for building a station at Kintore.

Cllr Martin Ford said:

“There is a very strong case for prioritising the proposed Kintore station for funding. All the investigative studies have concluded a station at Kintore will be well used, with a good benefit:cost ratio.

“A station at Kintore looks like a sound investment and good value for money.”

Cllr Ford has also welcomed some new and updated information relating to the planned delivery of the new station.

“In the emerging timetable, it looks like there will be 3–4 trains per hour serving Kintore,” said Cllr Ford.

“And to fit with the overall construction strategy for the upgrading works being undertaken along the line, the planned opening date for the new station at Kintore has been brought forward slightly – from March 2019 to December 2018. This is certainly good news.”

East Garioch councillor Martin Ford has welcomed progress on the new cycle path planned to connect Kintore with Port Elphinstone and Inverurie.

The intention is to have a cycle path adjacent to the A96 on the east side of the trunk road all the way between Kintore and Port Elphinstone.

The construction of the section between Kintore (starting by the entrance to the Overdon Care Home) and Kintore Business Park was agreed by the Garioch Area Committee in January. Work on this section is now almost complete.

Cllr Martin Ford said:

“A good cycle path between Kintore and Port Elphinstone will be a great help to anyone who cycles – or who would like to cycle – between Kintore and the Inverurie area, whether for recreation, to go shopping or to commute to work.

“The new section of path between Kintore and Kintore Business Park looks great. I shall continue to press for the planned linking cycle path between Kintore Business Park and the Thainstone roundabout to be built as soon as possible.”

Following representations from Cllr Ford, a feasibility study was undertaken in 2012 into the possibility of a cycle path between Kintore and Port Elphinstone entirely on the east side of the A96 over the full length of the route. There is currently a cycle path on the east side of the A96 between Port Elphinstone and the Thainstone roundabout.

Between Thainstone and Kintore until now though, there has been nothing for cyclists on the east side of the A96 – just a very poor path adjacent to the A96 on the west side of the road. Therefore, anyone wanting to cycle between Kintore and Port Elphinstone/Inverurie has had to cross the A96 dual carriageway near Thainstone or cycle part of the way on the trunk road itself.

Council officers are working on resolving remaining issues to enable a cycle path to be built between Kintore Business Park and the Thainstone roundabout.

In 2007, Aberdeenshire Council set itself ambitious targets to reduce its greenhouse gas emissions – but the Council has not yet managed to achieve consistent year-on-year reductions in the amount of carbon dioxide generated by its activities.

“The Council must do better at meeting targets to cut its carbon emissions,” said Cllr Martin Ford. “And make cutting emissions a higher priority. That means a new approach is needed to when and where the Council takes its decisions about how to reduce greenhouse gas emissions.”

Aberdeenshire’s Democratic Independent and Green Group (DIGG) councillors – Martin Ford and Paul Johnston – secured agreement last summer that the Council’s new administration would support improvements to decision making about reducing carbon emissions.

The DIGG councillors then wrote to Aberdeenshire Council’s co-leaders last September making a specific proposal that the Council sets a carbon budget each year – detailing how and where it aims to reduce its carbon emissions – and that the carbon budget is agreed by the full council at the meeting which decides the Council’s revenue and capital budgets for the year ahead.

The Council’s co-leaders have now written to Cllr Ford and Cllr Johnston indicating their administration’s support for the DIGG carbon budgeting proposal.

A report from officers on carbon budgeting is now expected at the 10 March Aberdeenshire Council full council meeting.

Cllr Paul Johnston said:

“We are very pleased the administration has agreed with us about the need to improve governance and decision making in respect of the Council’s duty to cut its carbon emissions. The Council has challenging and ambitious targets to meet and it is important every councillor is involved in the decisions needed to deliver on those.”

Cllr Martin Ford said:

“Aberdeenshire Council agrees its overall financial plans for the year ahead on budget day in February each year – the revenue budget, capital plan and housing revenue account budget. But there should really be a fourth budget decided alongside the ‘money budgets’ – the Council’s plans for reducing its carbon emissions resulting from its various activities.

“The carbon budget is interlinked with the money budgets because some measures to reduce carbon emissions will incur capital costs, but also deliver revenue savings. So all the budgets ought to be considered at the same meeting and be consistent with each other.”

Aberdeenshire Council, like all Scottish councils, is required by the Climate Change (Scotland) Act 2009 to exercise its functions ‘in the way best calculated to contribute to delivery of the Act’s emission reduction targets’. At the climate change conference in Paris late last year, 196 countries agreed to ‘hold the increase in the global average temperature to well below 2 °C above pre-industrial levels and to pursue efforts to limit the temperature increase to 1.5 °C above pre-industrial levels’.

A reformed budget setting process for Aberdeenshire Council was formally agreed at last Thursday’s  full council meeting. The new approach to deciding the authority’s annual revenue budget was first proposed last year by Democratic Independent and Green Group (DIGG) councillors Martin Ford and Paul Johnston, who wrote to the Council’s other political groups in March 2015.

“We want to see draft budget proposals coming forward from the various political groups in the autumn so there can be proper public consultation and cross-party dialogue and negotiation before the budget is set in February,” said Cllr Martin Ford. 

“This allows for much more scope for public input into budget decisions and creates opportunities for cross-party agreement and sharing of ideas.”

During the 11 February full council meeting, the DIGG plan attracted cross-party support and was praised by Council co-leader Cllr Richard Thomson. The officers’ report on Aberdeenshire’s 2016/17 revenue budget recommended that budget proposals for 2017/18 are initially reported to the full council next autumn, in line with the process put forward by the DIGG.

In his speech to the 11 February meeting, proposing the 2016/17 revenue budget, Cllr Martin Kitts-Hayes said:

“Linked to the importance of a budget consultation exercise is the early discussion on future years’ budget proposals. Therefore I propose that all groups prepare draft budget proposals and report these to Council in autumn.”

Said Cllr Paul Johnston:

“I welcome the cross-party agreement on this important reform. Ultimately, we believe this new budget process will lead to better budgets and more say for Aberdeenshire residents on these key decisions.”

In acordance with their own proposed budget process, the DIGG presented detailed draft proposals for Aberdeenshire’s 2016/17 revenue budget to the November 2015 Aberdeenshire full council meeting.

East Garioch councillor Martin Ford has welcomed progress towards improvements in school accommodation in the ward he represents.

Item 9 on the agenda at Aberdeenshire Council’s Education, Learning and Leisure Committee last Thursday (4 February) was an update on the Council’s Learning Estates Strategy.

During discussion of the Learning Estates Strategy report, Cllr Ford raised issues relating to local school accommodation including at Newmachar, Kintore, Blackburn and Hatton of Fintray.

Included in the learning estates project plan for 2016 is a Newmachar primary school option appraisal. Said Cllr Ford:

“House building is on-going in Newmachar and planning permissions for housing are in place on sites at Kingseat and on the east side of Newmachar – so the Council does need to move forward with planning for additional capacity at Newmachar.”

Land is reserved for a second primary school in Newmachar within the Newmachar East mixed-use development site.

Cllr Ford welcomed the reported good progress Morrison Construction are making with building the new Kintore Midmill School.

He said:

“After the long delay in getting started, it’s obviously excellent that the actual building work is getting on so well. The new school building is now clearly visible from a number of locations in Kintore.”

On the site choice for the replacement building for the current Kinellar School, Cllr Ford said:

“The choice between rebuilding on the present school site or continuing to try to acquire the replacement school site identified in the local development plan is not an easy decision. There are advantages and disadvantages with both options. Neither choice is risk free.

“On balance, the certainty that comes with the Council already owning the current school site is probably a decisive advantage. But the site identified for the new school in the local development plan is larger and moving the school to it would free up the present school site, potentially for other community facilities. The present site is smaller than ideal for the larger school needed.

“Also, there may be other planning applications for the site allocated in the local development plan for the new school if it is not used for that purpose.”

Cllr Ford raised concerns about the accommodation at Hatton of Fintray School. The Council’s rating of the overall suitability of the Hatton of Fintray school building is ‘C’ (= ‘poor – showing major problems and/or not operating optimally’). Cllr Ford said:

“Hatton of Fintray School Association has contacted the Council in particular about the lack of proper office facilities in the school for the head teacher and administrator, and suggested a way forward. I hope the Council will be able to respond positively.”

Cllr Ford also questioned officers about overall school roll forecasts for Aberdeenshire, which show continuing roll increases are expected in many areas.

“We have become used to ever-rising school rolls in much of Aberdeenshire,” said Cllr Ford.

“The forecasts predict that to continue. But will it? There’s no sector of the north-east economy that’s looking likely generate significant additional employment that will more than compensate for other job losses. So what would be the driver for population increases that would cause on-going rising school rolls?

“Increasing school rolls have been a given in many parts of Aberdeenshire for many years, but that might be going to change – and our planning for school accommodation would then need to change too.”

Officers assured Cllr Ford that school roll forecasts are kept under constant review.

Aberdeenshire Council faces some tough choices when it comes to set its revenue budget for 2016/17 on 11 February – but most of the savings required can be achieved without damaging services.

That is the view of the authority’s Democratic Independent and Green Group (DIGG) councillors Paul Johnston and Martin Ford.

“The Council does have scope to make a range of substantial savings in its budget that will not affect service delivery,” said Cllr Paul Johnston.

“For instance, compared with expectations, the Council will save well over £1 million on borrowing costs in financial year 2016/17, due to continuing low interest rates. Fuel and electricity prices are also lower than had been forecast. Demand for some services has been less than expected in 2015/16, meaning the current budget allocation is more than required.”

Said Cllr Martin Ford:

“The Council’s budget position has also been eased by additional income. New houses have been built and occupied bringing in additional Council Tax. Sales from the Council’s quarries are up by more than £1 million this year and next year’s budget can be adjusted to reflect an expected higher income too. The Council has gone for renewable energy – biomass and photovoltaic panels – to supply some of its buildings and this both saves on fuel or electricity costs and generates an income.”

The DIGG put forward draft budget proposals at the November 2015 Aberdeenshire Council meeting showing how the Council could effect savings of £17.97 million – slightly more than the total savings of £17.561 million then anticipated to be required to balance the 2016/17 revenue budget.

After the November Aberdeenshire full council meeting, officers identified further budget pressures. Then the Scottish Government’s grant settlement to the Council announced before Christmas was less than the ‘flat cash’ funding anticipated, creating a further £6.390 million shortfall for 2016/17. The Council thus now needs to find savings of £28.312 million to balance its 2016/17 revenue budget.

Since November, the DIGG councillors have been working on how further savings could be effected. While the Council will set a one-year budget on 11 February, it will do so in the context of knowing it needs to make at least a further £30 million of savings in the years to 2020.

The DIGG councillors have made clear their opposition to continuation of the Council Tax freeze.

Cllr Martin Ford said:

“Vital public services such as education and social work must be protected from cuts as top priority. To do that, the Council must re-examine everything it does and seek increased efficiency whenever possible.

“There is certainly scope for some genuine efficiency savings.

“The Council could replace stand-alone public toilets with partnership arrangements for public access to toilets in buildings such as hotels, both improving the service and reducing costs.

“We also believe the Council can make further savings by additional investment in energy efficiency, such as LED street lights, and renewable energy.”

The DIGG is a separate and independent group on Aberdeenshire Council that reached a ‘confidence and supply’ agreement with Aberdeenshire’s new administration last year. Some specific budget commitments were included in that agreement.

Said Cllr Paul Johnston:

“The new administration has already accepted our conditions that there are no cuts to the community learning and development budget line, £250,000 is transferred to increase the budget for cycling and walking and £100,000 is redirected to preventative local health and social care services, specifically to fund third-sector organisations in Aberdeenshire to support vulnerable residents achieve or maintain independent living.”
